Terms of Service.

These Terms of Service govern access to and use of the services provided by Trusted Carrier Logistik GmbH (hereinafter referred to as Trusted Carrier):

By accessing or using the service, users agree to these Terms. If users act on behalf of an organization, they confirm that they are authorized to bind that organization.

These Terms should be read together with the Privacy Policy and the Cookie Policy.

Trusted Carrier provides a verification and trust infrastructure that enables organizations to confirm the identity, authority, and operational readiness of companies and individuals in logistics, transport, insurance, and related workflows.

The service facilitates verification, authorization, and controlled data sharing between independent parties.

Trusted Carrier acts solely as a technical infrastructure provider and does not act as a contracting party, employer, insurer, logistics operator, or decision maker in any transaction between users. All operational, commercial, and legal decisions remain the responsibility of the respective parties.

The service is primarily intended for use by organizations.

Individuals such as drivers, employees, subcontractors, and other representatives may initiate or participate in verification processes, including by linking themselves to an organization or operational workflow.

Individuals are not considered independent primary contracting parties unless explicitly agreed.

Organizations are fully responsible for:

• the actions of individuals acting under their authority
• ensuring that such individuals are authorized to use the service
• the accuracy and legality of all data submitted

Individuals acknowledge that their participation is linked to an organization or operational context.

By initiating or participating in verification workflows, individuals acknowledge that their data will be processed as necessary for verification, authorization, fraud prevention, and operational security.

Trusted Carrier does not assume responsibility for employment, contractual, or operational relationships between individuals and organizations.

Users must provide accurate and complete information and must keep access credentials secure.

Users are responsible for all activities carried out through their accounts.

Trusted Carrier may suspend or restrict access for legitimate reasons, including security risks, misuse, or compliance requirements.

Users and organizations are solely responsible for ensuring that all submitted data is accurate, complete, and up to date.

Trusted Carrier uses commercially reasonable efforts to verify information using available data sources. Where verification relies on official or direct sources, results reflect those sources at the time of verification. Where such sources are unavailable, verification may rely on aggregated data, third party inputs, or automated analysis.

Trusted Carrier does not guarantee that all information is complete, current, or error free.

Users and organizations are fully liable for any false, misleading, incomplete, or unauthorized information and for all resulting consequences.

Use of verification results is at the user's own risk. Verification does not constitute certification, endorsement, or guarantee and does not replace independent due diligence.

Verification does not create any contractual, advisory, or fiduciary relationship between Trusted Carrier and any verified individual or third party.

Where required, the service may use biometric verification to confirm identity.

By participating in such processes, users acknowledge that biometric data may be processed in accordance with the Privacy Policy.

Where biometric verification cannot be completed, alternative procedures or escalation may be used where reasonably feasible.

The service may use automated systems to support verification, document validation, and risk detection.

These systems assist decision making but do not replace human judgment where required.

Users may request review of outcomes where applicable.

The service enables controlled sharing of verified information between independent parties.

Users authorize such sharing where necessary for verification and operational purposes.

Recipients are solely responsible for lawful use of received data.

Trusted Carrier does not control how independent parties interpret or use verification results.

Organizations may use the service to verify subcontractors or other third parties.

Trusted Carrier does not assume responsibility for relationships or conduct of such parties.

Verification does not constitute endorsement or guarantee.

Users must not:

• provide false or misleading information
• impersonate others or misrepresent authority
• misuse verification processes
• attempt to bypass security mechanisms
• use the service for unlawful purposes

Trusted Carrier may suspend or terminate access in case of violations.

Trusted Carrier aims to provide reliable services but does not guarantee uninterrupted or error free availability.

Service availability may be affected by maintenance, updates, or technical issues.

Trusted Carrier will use reasonable efforts to provide advance notice of planned maintenance that may materially affect the service.

To the extent permitted by law, Trusted Carrier is not liable for:

• decisions made by users or organizations
• incorrect, incomplete, or outdated data
• reliance on verification results
• actions of third parties
• indirect or consequential damages

Nothing excludes liability for intent, gross negligence, or mandatory legal obligations.

The service is provided as is and as available.

Trusted Carrier makes no warranties regarding availability, accuracy, reliability, or suitability of the service for specific purposes.

Users are responsible for determining whether the service meets their needs.

Users and organizations agree to indemnify and hold harmless Trusted Carrier from any claims, damages, losses, liabilities, and expenses arising from:

• false, misleading, or unlawful data
• unauthorized or improper use
• violation of these Terms
• misuse of verification results

This includes claims brought by third parties.

Access to certain features of the service may require a paid subscription.

Subscription plans, fees, and included services are described on the Trusted Carrier pricing page.

Unless otherwise stated, subscriptions are concluded for a fixed term of twelve (12) months and renew automatically for successive periods of the same duration unless terminated prior to the end of the current term.

The automatic renewal is clearly indicated at the time of subscription.

Users may terminate subscriptions with a notice period of thirty (30) days prior to the end of the current subscription term.

Trusted Carrier may issue invoices or payment reminders prior to renewal. Such communications are provided for convenience and do not replace the user's responsibility to manage subscription terms.

Fees are payable in advance and are non refundable, except where required by applicable law.

If payment is not received when due, Trusted Carrier reserves the right to suspend or restrict access to the service until payment is made.

Trusted Carrier reserves the right to modify pricing for future subscription periods.

Personal data is processed in accordance with the Privacy Policy.

Users and organizations are responsible for ensuring lawful data submission.

All rights to the service remain with Trusted Carrier or its licensors.

Users may not copy, modify, distribute, or misuse the service.

Trusted Carrier is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, cyber incidents, infrastructure failures, or actions by public authorities.

Trusted Carrier may suspend or terminate access for legitimate reasons, including security, compliance, or misuse.

Users may discontinue use at any time.

These Terms are governed by the laws of Germany.

For users acting in a commercial or professional capacity, the exclusive place of jurisdiction is Munich, Germany.

Where users qualify as consumers, mandatory consumer protection provisions remain unaffected.

If any provision is invalid or unenforceable, the remaining provisions remain in full effect.

This does not affect the right to seek legal remedies before courts or authorities.

Trusted Carrier may update these Terms from time to time.

Continued use of the service constitutes acceptance of the updated Terms.
